Here you can read our complete Terms of purchase which include general information about ordering, payment, delivery, complaint, right of withdrawal and open purchase. When you place an order with us, you agree to these terms.

1. About these Terms of Purchase

1.1 These terms and conditions (the "Terms of purchase") apply to all purchases that you or the company that you represent ("you") make from SIGMA Imaging Nordic AB

1.2 The Terms apply to purchases made from any of the SIGMA Imaging Nordic websites in the Nordic & Baltic countries [sigma-imaging.se / sigma-imaging.no / sigma-imaging.fi / sigma-imaging.dk / sigma-imaging.ee / sigma-imaging.lv / sigma-imaging.lt]. Purchase agreements are entered into with SIGMA Imaging Nordic AB, VAT# SE559236176901 (Sweden, Finland, Denmark, Estonia, Latvia, Lithuania) or VAT# 925 977 284 MVA (Norway). Address: Kungsholms Strand 157, 112 48 Stockholm, Sweden.

2. Ordering

2.1 By shopping with us, and thereby accepting the Terms of Purchase, you agree to comply with the Terms of Purchase on your own behalf. If you represent a company, you accept the Terms of Purchase on behalf of the company and warrant that you have the authority to accept them and to make purchases on behalf of the company.

2.2 To make a purchase as a private individual, you need to be over 18 years of age and have the right to enter into agreements under applicable law, e.g. not be under guardianship.

2.4 We cooperate with other companies, such as financing companies etc. If you enter a contract of financing services for your purchase of products, you then also enter into a separate agreement with the financing company that may apply different terms than SIGMA. Please make sure you read their Terms and Conditions as well. 

3. Order and delivery confirmation

3.1 Once you have completed your purchase on the Website, you will receive an automatic mail confirming that we have received your order. The order confirmation is not a binding order confirmation and does not mean that a binding agreement has been entered into. A binding contract is only concluded when the delivery confirmation is sent.

3.2 Before the final delivery confirmation has been sent, we may refuse your order in whole or in part, for example if you have provided incorrect information to us at checkout, if we suspect attempted fraud or due to final sale. In such cases, we will notify you as soon as we can.

4. Products with digital elements

4.1 Some of our products are interconnected or integrated with digital content or digital services. This means that the product will not function in whole or in part without the digital content or service. For example, it can be about operating systems, applications and other software that may be pre-installed at the time of purchase or installed at a later date. You will have access to or access to these digital elements in connection with the purchase - unless otherwise stated when you shop.

4.2 We will provide you with information about and provide you with the updates necessary for the functioning of your product with digital elements as required by mandatory consumer law.

5. Prices and VAT

5.1 When ordering, the prices stated on the Website at the time of ordering apply. All prices are presented in local currency. For private consumers prices include applicable VAT. For companies the prices are displayed excluding VAT*.
Prices do not include any payment and shipping fees, which are listed separately when you check-out. We reserve the right to correct any order that is potentially wrong VAT wise for you as a customer.
*Make sure you are shopping in the “Business/Reseller” web view if you are a company. Double check it says “Excl. VAT” at the price. 

5.2 If the price or information about a product listed on the Website is incorrect and you realised or should have realised this, we are entitled to change or cancel your order. Price and information about product/s are provided with reservation for printing and typing errors, errors in stated technical specifications and technical issue with website causing any wrong pricing or information.

5.5 For those who conduct a VAT-registered business in Finland, Denmark, Estonia, Latvia or Lithuania will not pay VAT on their purchases. As SIGMA has registered companies in both Sweden and Norway, those with a VAT- registered business in Sweden or Norway will therefore pay VAT as they usually do when buying products in their countries.

6. Payment

6.1 In cooperation with our payment service provider Svea Bank AB (Publ.), you can choose from several different payment options*. Depending on whether you shop as a private person, company or authorized reseller and depending on whether you choose to enter social security number or organization number, we offer different payment options such as card payment, invoice payment, partial payment, account payment and direct payment via internet bank. Any restrictions on payment options may apply.
*They can be different country to country. Please check available options at check-out.

6.2 In connection with the payment, a separate agreement is entered into with Svea Bank AB (Publ) with separate terms and conditions that are stated in the cashier. Click here to read the payment terms for Svea Checkout.

6.3 If you have made your purchase on the Website, you can quickly and easily get an overview of your current SVEA invoices via www.mypages.svea.com.

6.4 For some legal entities and Resellers, we offer the option to purchase via a SIGMA invoice after a completed credit check and validation of reason. The payment term for an invoice varies depending on the agreement. In the event of a payment reminder, a statutory reminder fee and interest on late payment will be added in accordance with current interest legislation. In debt collection, the debt collection company's costs and fees are added according to applicable law.

7. Shipping and delivery

7.1 We deliver directly to you or the nearest pick-up point provided by the delivery partner. The delivery partner can vary and might change country by country and over time.  You can select between STANDARD or EXPRESS delivery at checkout. 

7.2 Depending on the shipping option you choose, shipping fees will apply. The amount of the shipping fee is shown at checkout.

7.3 You can find information about your current shipping options on the Website and at checkout. Keep in mind that all delivery options require identification or signing when you receive the package. 

7.4 The expected delivery time depends on the delivery option you choose and whether the product is in stock.

7.5 If your order contains several products, some of which are not in stock with us, we may send the products in several deliveries to you. In such cases, partial delivery will take place at no extra cost.

8. Uncollected packages

You are responsible for receiving or picking up your delivery in accordance with what is stated in the instructions you receive in connection with the order. Packages at postal agents that are not picked up within the time stated on the notice will be sent back to our warehouse. In these cases, we are entitled to charge an administrative cost of at least SEK 395 plus the return freight cost. The sum corresponds to our costs for handling and shipping in cases where you do not pick up the package at the postal agent or receive your package by courier or home delivery. The administrative cost and return freight will be invoiced or deducted from any credit that will be made.

9. Offers, discount codes and gifts

10.1 We may from time to time offer promotions, discount codes, gifts and other offers ("Offers"). Such Offers are only valid for the duration specified in connection with such Offer and with the terms and conditions stated in connection with the Offer. Offers cannot be combined with other discounts unless expressly stated on the Website.

10.2 You will need to enter any code or otherwise activate the relevant Offer before completing your purchase in order to take advantage of the Offer. If you return ordered products, it may mean that you no longer meet the specific conditions that apply to the Offer, which may mean that in such cases you need to return any gift or can no longer receive a certain discount. Otherwise, these Terms of Purchase also apply to Offers.

11. Right of withdrawal and open purchase

Note: Any return must be registered and pre-approved by SIGMA Customer Service before send back.

11.1 As a private consumer (not companies) you have the right to cancel the purchase within 14 days from the day that you, or a person on your behalf, receives the product that you have purchased. For companies, however, we will judge case by case.

11.2 If you have ordered and received a product that we have specially ordered on your behalf, the right to return the product is forfeited. For accessory products, the right to return only applies if you have not broken the packaging, read more about it below. 

11.3 If you buy a product, you have a right to inspect it in the same manner as you have the opportunity to do in a physical store. But in some cases, we may have a right to compensation because the product decreased in value (depreciation deduction). Such a deduction is only relevant if you have examined or used the product more than necessary. Make sure to be careful with the product packaging, accessories etc. (do not open accessory bags or packaging until you are sure you going to keep the product).

11.4 Exemptions for certain products 
Some products are excluded from the right of withdrawal and open purchase. This applies to nonphysical products (services, software etc.) as well as products with sealed audio or video recording or a sealed computer program where you have broken the seal. Products with a seal that due to health or hygiene reasons (e.g. in-ear headphones) cannot be returned if you have broken the seal on the product. Digital licenses where you have expressly consented to the commencement of delivery and agreed that there is thereby no right of withdrawal. For open purchase, products with storage media that have broken packaging such as hard drives, memory cards, computers and mobile phones are excluded, as well as consumables with broken packaging such as ink cartridges, batteries, photo paper, developing, cleaning and similar products. Also excluded are products with a subscription. For companies, specially ordered products outside the regular range are exempt from open purchase.

11.5 Depreciation and used products for consumers
If you as a consumer exercise your right of withdrawal or open purchase within 14 days, we are entitled to make a depreciation deduction before making your refund if you use the product more than necessary to establish its nature, characteristics and function. The amount of the deduction is determined by comparing the value of the product upon return compared to the original value at the time of purchase. To get a full refund in case of withdrawal, we therefore recommend that you send the product back in its original condition, in original packaging and with all parts and accessories unopened.

11.6 Depreciation and used products for companies 
For companies, in order to get a full refund on open purchase, the product and the product packaging must be in new condition where any seal is not broken. In cases where the packaging is broken, we charge either a depreciation deduction or refuse the return. The amount of the deduction is determined by comparing the value of the product upon return compared to the original value at the time of purchase. 

11.7 How to return your purchase in case of right of withdrawal and open purchase If you wish to cancel your purchase, you must notify us within 14 days of the day on which you, or a person on your behalf, receives or collects the Product. You can let us know by contacting our customer service by email at [SIGMA Customer Service], by phone [+46 (0)10-171 07 70] or by making a [Return Registration]. We will then help you with your return. 

11.8 After you have notified us that you wish to return your purchase, you will need to return the product within 10 days. We recommend that you send the product back in the same packaging (in the same outer box) as you received it. You are responsible for any damage or loss during the return shipping caused by your negligence, for example when packaging the product.

11.9 Return shipping Contact our Customer Service for the return shipment and they will provide the information and cost. Basic cost is roughly 119 SEK (SE) / 119 NOK (NO) / 99 DDK / 14 EUR (FI) / 18 EUR (Baltic region). You will receive information about your current return cost when you notify us that you want to cancel your purchase. The cost of return shipping will be deducted from your refund or deducted when crediting your invoice.

11.10 Repayment. Once you have returned the purchase/product, we will make your refund through our payment service provider within 14 days. However, we will not make the refund until we have received the product back and checked its condition.

11.11 Refunds will be made to you using the same payment method you chose at the time of purchase. If you have chosen to pay by invoice and the due date has passed and you have paid for the product, you will receive a credit and a refund to your account.

12. Warranty

12.1 All our products are under a two (2) year standard product manufacturing warranty. Information about which products are covered by what warranty can be found on the Website. There is also an option to get an extended warranty by registering your product. See more info at following link.

13. Complaints

13.1 If there is something wrong with your product, you have the right to complain about the faulty product in accordance with mandatory consumer protection legislation that applies in the country where you have your habitual residence. In Sweden, you as a consumer have a three-year right of complaint and you who shop as a company have a two-year right of complaint according to the Sale of Goods Act. If you want to complain about a product, you must contact us within a reasonable time after you have discovered the error.

13.2 Some of our products may have a shorter shelf life and may affect the assessment of whether or not there is an original fault.

13.4 Once the claimed product has been received and we have established that the complaint is valid, we will reimburse you in accordance with applicable law. However, we have the right to deny a complaint if it turns out that the product is not faulty according to what applies by law. If the complaint is not valid, we have the right to charge an administrative fee of SEK 690, which corresponds to our costs for examination of the product (excl. shipping costs). To avoid such a cost, we recommend that you contact our customer service and describe the error before returning the product to us.

14. Our obligations

14.1 If you have acted as a private individual and there is something wrong with your product we are obligated to help you in accordance with applicable mandatory consumer protection legislation. However, we will only be liable for damages to the extent that you have taken reasonable steps to limit your damage. 

14.2 We are not liable for damage caused by unforeseen circumstances beyond our control, such as war, strike, pandemic or natural disasters, which we could not reasonably foresee (Force Majeure). If, due to Force Majeure, a party is prevented from fulfilling its obligations under the agreement or these Terms of Purchase, each party has the right to withdraw from the agreement without the obligation to compensate the other party for any damage or loss.

15. About these Terms of Purchase

15.1 We have the right to change these Terms of Purchase, but the Terms of Purchase that you accepted at the time of your purchase always apply to that purchase. All changes will be stated in the latest published version of the Terms of Purchase on the Website. Changes come into force from the time you have accepted the Terms of Purchase, i.e. when you make a new purchase on the Website.

15.2 These Terms of Purchase shall be interpreted and applied in accordance with Swedish law. If any provision of these Terms and Conditions is held to be invalid or unenforceable by any competent court, authority or alternative dispute resolution entity, the remaining parts of that provision and all other provisions of these Terms and Conditions will remain valid and enforceable in full in accordance with applicable law. You are always entitled to the mandatory consumer rights of the country where you have your habitual residence. Nothing in these Terms of Sale shall be construed as limiting such rights.

16. Limitation of Liability of Companies

For customers acting as a company, we are not responsible for indirect losses or loss of profits. In addition, our liability under these Terms of Purchase for each loss or damage is limited to an amount corresponding to the total amount paid by the customer to SIGMA for the product from which the loss or damage is related or originates.

17. Questions, complaints or disputes

17.1 You are welcome to contact us if you have any questions or complaints regarding your order. You can easily reach us via the contact details set out at the beginning of these Terms of Purchase.

17.2 In the event of a dispute with private individuals, we follow decisions from alternative dispute resolution bodies. You can contact ARN through their website or by sending a letter to Box 174, 101 23 Stockholm.]

17.3 As an individual, you also have the opportunity to complain via the EU's web-based platform for dispute resolution, which you can reach here.

17.4 Notwithstanding the above, any dispute may also be settled in any competent court in the country where the Customer is domiciled. For company acquisitions, disputes shall be settled by a general court with Stockholm District Court in Sweden as the first instance.
